BALCA Decision Regarding Advertising for Multiple Job Openings

BALCA analyzed whether the newspaper advertisement sufficiently apprised U.S. workers of the job offered. BALCA held that although it was clear the advertisements were for multiple job openings, it was not clear “the experience requirements only applied to some positions.” BALCA averred that “when an employer advertises for multiple positions that have varying job requirements, the employer must carefully draft its advertisements to let U.S. workers know which requirements apply to all positions and which requirements only apply to some of the positons.”; BACLA conclude Employer’s newspaper advertisement(s) was not specific enough to apprise U.S. workers of the job offered.
